Abstract

Introduction to The Problem: Venezuela held a referendum on December 3, 2023, within its own borders, to address territorial matters with the indigenous communities of Guyana. The referendum was conducted in accordance with the indigenous Pemon community's desire, originating from the Essequibo area of Guyana. Guyana asked the International Court of Justice (ICJ) to block the act of Venezuela, but the voters rejected the ICJ and continued doing the referendum.

Purpose/Objective Study: This study aims to examine the settlement dispute, especially between Venezuela and Guyana, through the International Court of Justice (ICJ). Does the ICJ have jurisdiction over the territorial dispute between Venezuela and Guyana, particularly concerning the potential impact of the Venezuela referendum on the land rights and self-determination of indigenous peoples of Guyana? How did the ICJ handle the dispute from the Venezuela referendum, and what legal principles and precedents were used in resolving the territorial dispute?

Design/Methodology/Approach: This research adopts a socio-legal approach to analyze the dispute resulting from the Venezuelan referendum regarding the territorial issues of the Indigenous Community of Guyana.

Findings: The ICJ thoroughly examined the legality of the 1899 arbitration decision, carefully assessed the established territorial boundaries, and considered the potential harm to the rights and interests of the Guyanese people. These findings underscore the complex interplay between legal principles and practical challenges, highlighting the need for cooperation and diplomacy in effective international dispute resolution. The ICJ holds jurisdiction over the longstanding territorial conflict between Venezuela and Guyana as outlined in the 1966 Geneva Agreement and reinforced by the December 2020 resolution. The court's recent decision to delay Venezuela's planned referendum reflects its recognition of the potential consequences that unilateral actions might have on the land rights and self-determination of Guyana's indigenous communities, emphasizing the court's commitment to balanced and careful adjudication.

Yordan Gunawan, Faculty of Law, Universitas Muhammadiyah Yogyakarta and Facultat de Dret, Universitat Pompeu Fabra, Spain

Yordan Gunawan is a Senior Lecturer at the Faculty of Law, Universitas Muhammadiyah Yogyakarta, where he previously served as the Director of the International Relations Office. He is also a member of the Indonesian Advocates Association (IKADIN).

Yordan holds a Bachelor of Laws and a Master of Laws in Public International Law from the School of Law, Universitas Muhammadiyah Yogyakarta. In addition to his notable academic and professional accomplishments, Yordan Gunawan earned his Master Business and Administration from the Institute of International Management, National Cheng Kung University, Taiwan, Republic of China, with a scholarship from the Taiwanese government. Throughout his academic journey, Yordan actively engaged in seminars and discussions and made contributions to local publications, providing insights into contemporary legal issues. Furthermore, Yordan is currently pursuing his Ph.D. research in the Department of Law and International Relations at Facultat de Dret, Universitat Pompeu Fabra, Barcelona, Spain. He is a certified mediator recognized by the Supreme Court of the Republic of Indonesia. Yordan is also an alumnus of the National Resilience Institute “LEMHANNAS” of the Republic of Indonesia, 2023.

Yordan has an extensive publication record, with numerous articles published in various national and international journals. He has presented his research at a global level, participating in various international conferences, seminars, and activities held in countries such as Ireland, Turkiye, Taiwan, Thailand, Singapore, the United States of America, the Philippines, Azerbaijan, Australia, the Netherlands, the United Kingdom, Belgium, France, Vietnam, Japan, Malaysia, South Korea and many more.

His primary research interests lie in Public International Law, International Dispute Settlement, the Law of International Organizations, and International Environmental Law. Yordan has also exhibited leadership qualities as the Chairman of the Association of International Offices of Muhammadiyah Higher Education Institutions (ASKUI PTMA), where he oversees more than 90 International Offices in Indonesia. In addition to his notable academic and professional accomplishments, Yordan Gunawan currently holds the position of Chairman of the Special Branch of Muhammadiyah (Pimpinan Cabang Istimewa Muhammadiyah, PCIM) in Spain.
